Another LLC Question - Which State to Incorporate in ?

Hi Jon,

It is early days for me in this business, very new to afffiliate marketing. I want to start off on the right foot with the legal side of the business and want to use the company details when registering for the affiliate programs etc.

1) I live in NY , do I have to register an LLC in NY because I reside here. I have been looking at Delaware and Vermont ( they are coming up with the virtual LLC option at some stage , has been in the press). Seeing the Internet business could be operated from anywhere with the office address in another state could I register the business in another state.

2) Do you have a website for your accounting practice, could you suggest any local NYC CPA's. I have an attorney already.

Hi Queueposition,

To be totally legit and legal you need to form the entity where you are going to do business physically. This means that if you work at home or in an office in New York, you need to file for your LLC in New York. That is how this works in all states. That is not good news to you for the sales tax gumbo going on there.
